Section 58: Fresh poll in case of destruction etc. of ballot boxes

The Haryana Municipal Elections Rules, 1978State Rules of Haryana · 1973

(1) If at any election any ballot box used at a polling station or at any other place fixed for the poll is unlawfully taken out of the custody of the Presiding Officer or is accidentally or intentionally destroyed or lost or damaged or tampered with and the Returning Officer is satisfied that in consequence thereof the result of the poll of that polling station or place cannot be ascertained, he shall report the facts to the State Election Commissioner, Haryana who shall-

(a) declare the polling at that polling station to be void;

(b) appoint a day and fix the hours for taking a fresh poll at the polling station; and

(2) The provisions of these rules shall apply to every such fresh poll as they apply to the original poll.
