Section 17: Repeal and savings

The Himachal Pradesh Electricity Regulatory Commission (General Conditions of Trading Licence) Regulations, 2004State Regulations of Himachal Pradesh · 2003

(1) Save as otherwise provided in these regulations, the general or specific conditions for the grant of the trading licence laid down under the Indian Electricity Act, 1910 or the Electricity Regulatory Commissions Act, 1998 or any other law in force immediately before the commencement of these regulations are hereby repealed.

(2) Notwithstanding such repeal anything done or any action taken or purported to have been done or taken under the repealed general or specific conditions for the grant of a trading licence shall, in so far as it is not inconsistent with the provisions of these regulations, be deemed to have been done or taken under the corresponding provisions of these regulations.

(3) The specific conditions for the grant of trading licence and directions issued before the commencement of these regulations (including those given both at the public hearings and in the Tariff Order as contained in Chapter 7 of the Tariff Order 2001-02 issued under the Electricity Regulatory Commissions Act, 1998), not inconsistent with the provisions of these regulations, shall continue to apply for the period for which such general or specific conditions and directions were issued.

By Order of the Commission -Sd- Secretary 10 Compendium of HPERC Regulations, March 2021 Notification and Orders issued Under The Himachal Pradesh Electricity Regulatory Commission (General Condition of Trading Licence) Regulations 2004 1 [The Himachal Pradesh Electricity Regulatory Commission (Fixation of Intra-State Trading Margin) Order, 2008] ORDER Dated 5 th Sept., 2008 No. HPERC/382.- In exercise of the power conferred under section 86 (1) (j) of the Electricity Act, 2003, read with sub-regulation (3) of regulation 13 of Himachal Pradesh Electricity Regulatory Commission (General Condition of Trading Licence) Regulations 2004, the Himachal Pradesh Electricity Regulatory Commission makes the following Order for the fixation of Intra-State trading margin as under:-

1. Short title and commencement.- (1) This Order may be called the Himachal Pradesh Electricity Regulatory Commission (Fixation of Intra-State Trading Margin) Order, 2008

(2) The Order shall come into force on the date of its publication in the Rajpatra, Himachal Pradesh.

2. Applicability:-This Order shall be applicable to intra-State trading within the State of Himachal Pradesh.

3. Trading margin.-The maximum intra-State trading margin shall not exceed 4 paise/kWh including all charges, except the charges for scheduling of energy, open access and losses.

Explanation.- The charges for the open access include the transmission charges and wheeling charges, surcharge, additional surcharge, operating charges, UI charges, reactive energy charges etc. and the application fee.
