Section 42: Powers of Authority to require Local Authority to assume responsibility for maintenance of amenities

The Himachal Pradesh Housing and Urban Development Authority Act, 2004State Act of Himachal Pradesh · Act 9 of 2004

(1) Where any area has been developed by the Authority or by the Promoter, the same shall be entrusted to the Local Authority within whose limits the area so developed is situated for discharging its municipal functions.

(2) If any amenity has not been provided by the Authority or by the Promoter which otherwise should have been provided, the Authority or the Promoter, as the case may be, shall pay an amount equivalent to the cost of such amenities to the Local Authority.

(3) Where money has been collected by the Authority or by the Promoter for the proposed amenities but not utilized, the same shall be transferred to the Local Authority for providing the same.
