Section 212: Power to lay mains, service pipes etc

(1) The Municipal Commissioner or the Executive Officer may, either on his own or through any other agency, lay whether within or outside the municipal area, a main, or such service pipes with such stopcocks and other water fittings as he may deem necessary for supply of water to premises–

(a) in any street, and

(b) with the consent of every owner or occupier of any land, not forming part of a street, in, over or on that land, and may, either on his own or through any other agency, from time to time, inspect, repair, alter, or renew or may, at any time, remove any such main, or service pipes, so laid, whether under this section or under any other provision of this Act:

Provided that where a consent required for the purposes of this sub-section is withheld, the Municipal Commissioner or the Executive Officer may, after giving the owner or the occupier of the land a notice, in writing, of his intention so to do, either on his own or >kj[k.M xtV ¼vlk/kkj.k½] o`gLifrokj 9 Qjojh] 2012 517 through any other agency, lay the main or the service pipes, as the case may be, in, over or on that land without such consent.

(2) Where a main or a service pipe has been lawfully laid in, over or on the land not forming part of a street, the Municipal Commissioner or the Executive Officer or any other agency authorised by him may, from time to time, enter upon that land and inspect, repair, alter, renew or remove the pipe or lay a new pipe in substitution thereof, but shall pay compensation for any damage done in the course of such action.
