Section 54: Publication of orders made under section 67 or section 69

Every order made under sub-section (2) of section 67 or sub-section (2) of section 69 shall - 30 - be published at office of the Jharkhand State Wakf Board. a copy thereof shall also be sent to the Mutawalli of the wakf concerned.

55. Application for inquiry under section 70 of the Act- An Application under section 70 shall be filed in form 61 accompanied by an affidavit duly sworn by the applicant and a receipt in form 70 of payment of a fee of Rs. 100 to the Board.

56. Demand and Recovery of Wakf contribution U/s 72 the wakf Act-

(1) The Mutawalli shall furnish to the Chief Executive Officer of the Board or authorized persons on his behalf, a statement with description and assessment of the net annual income of the wakf and the contribution payable by it in Form 62 and 63 before 30th April or each year.

(2) The Chief Executive officer or any officer authorized by him shall verify the said assessment and fix up the actual demand for payment of wakf contribution at the rate of seven percent by on or before the 30th June and shall maintain a Register of Demand, collection and Balance in form 64.

(3) The Chief Executive officer or any authorized officer by him shall maintain a district wise Demand Register based on such Assessment and shall also keep a copy of Demand prepared with reference to each wakf state in form 65 and Board shall also keep and maintain a Register of those wakf states which are not liable to pay the wakf contribution with all the details and descriptions given in form 66. The C.E.O shall occasionally depute his inspectors/auditors/ A.O. to verify assess and scrutinize the prevailing income and expenditure along with not annual income. The officer after such scrutiny shall report the matter to the C.E.O. as to whether they are liable to pay against Wakf Contribution at the rate of 7% of the board and if no. The concerned Wakf institution shall be debuted from register to maintainer in form 66.

(4) Every Mutawalli who fails to pay the wakf contribution shall be issued with a Notice regarding the payment of wakf contribution in form 67.

(5) If the Mutawalli fails to pay the amount of demand under sub -rule (4) proper action shall be taken to recover the same as arrears of land Revenue under sub- rule (3) of Rule 44.

(6) In the event of Mutawalli failing to submit the details under sub-rule (1) the chief Executive officer or any other officer authorized in his behalf shall assess the net annual income in the manner prescribed under sub-rule (2) and shall fix the wakf contribution payable by the said wakf - 31 -

(7) The Chief Executive officer or any authorized officer, if needed, shall revise the net annual income after issuing a notice to the Mutawalli / Managing committee in Form

(8) The Chief Executive officer or authorized officer shall issue notice in form 69 for the purposes of sub-section (8) of section 72 to mutwalli.

(9) The Notice in form 69 shall be deemed to be the direction of the Board and in case of failure to carry out the said direction, the Mutwalli shall be deemed to be violating the provisions of clause (F) or sub-section (1) of section 61 of the act and shall be punishable within the said provision along with the recovery of the amount under sub-section (8) or action 72 which will be remitted to the fund of the Board by the court concerned.

57. Chief Executive officer to lodge complaint U/s 61 of the Wakf Act- The Chief Executive officer shall under this rule be competent to institute complaint against an offence under section 61 in the court of Chief Judicial Magistrate Patna or any other first class Judicial Magistrate at Ranchi.
