(1) Any party aggrieved by the decision of the Board under Sub-Section (1) of Section 40 and Sub-Section (3) of Section 40 may file an appeal to the Tribunal within thirty days from the date of decision.
(2) Any person aggrieved by an order of the Chief Executive Officer under Sub- Section (3) of Section 54 may institute a suit in the Wakf Tribunal within sixty days from the date of said order.
(3) In case any body aggrieved form the order Of the Board or the Chief Executive Officer failed to file appeal within the prescribed time, if good cause shown, the tribunal may condone the delay if any in filling the appeal.
(4) Further appeal shall not deemed to be stay of any order under appeal, until stayed by the Tribunal, but the jurisdiction of stay shall be used sparingly by the tribunal keeping in view of the facts and circumstances of the case.
(5) After admission of appeal, the tribunal shall order the appellant to file requisition for issuing the notice or notices to the respondent or respondents within specified period falling which the appeal will be dismissed as to the discretion of the Tribunal.

(6) For the purpose of the notice, the appellant shall file copy of memo f appeal and envelop with A/D & stamp for each every respondent in the Shrista of the Tribunal which will be issued by Pestakar to the respondent/respondents and the procedure of Service of the notice will be done as per provision of the code of Civil procedure.
After hearing of the appellant or appellants and respondents or their respective lawyers the tribunal will pass an order as deemed just and proper and the order will he final.
