Section 13: Manner of enquiry

(1) Before the order refusing to register or of removal of the name from the register is passed in pursuance of rule 12 the Council shall make or cause an enquiry to be made and shall call upon the person for explanation or defence. If the Council is of opinion that the name of such person should not be registered or should be removed, as the case may be, it may be pass such an order.

(2) An enquiry under the foregoing sub-rule shall be instituted by the issue of a notice in writing on behalf of the council by the Registrar addressed to the person. Such notice shall specify the nature and particulars and inform him of the day on which the Council intends to deal with the case and shall call upon the person to answer in writing and to attend before the council on such day. The notice shall be sent at least three weeks before the date of an enquiry.

(3) Any notice or order under the aforesaid provision shall be sent by registered post to the person at his permanent address appearing in the register, or given in the application.
