Section 3: Method of Transfer

The Karnataka State Police Department (Transfer) (Special) Rules, 2022.State Rules of Karnataka · 1990

The following method of transfer shall be followed in case of,-

(1) Police Sub Inspector (Civil/CAR/DAR) or equivalent post

(i) In cases where both husband and wife are in Government service and a request for transfer under these rules is made by a spouse, from a post in one unit of seniority in a Range/Commissionarate to an identical post in the same cadre in another unit of seniority in another Range/Commissionarate, the competent authority can consider the request for transfer subject to the following conditions, namely:-

(a) the PSI (Civil/CAR/DAR) must have satisfactorily completed the probationary period; and

(b)the provision of rule 16-A of and the general instructions that may be issued by the Government from time to time under the Karnataka Civil Services (General Recruitment) Rules, 1977 shall apply mutatis mutandis to such request for transfer.

(ii) the PSI (Civil/CAR/DAR) who is an Ex-service men, he must have completed minimum period of three years service and must have satisfactorily completed the probationary period.

(iii) Sanctioned post shall be vacant and available in the unit or place to be transferred in a Range/Commissionarate.

(iv) Such transfer shall not be permissible from one cadre to another cadre.

(v) Since the appointment being made at the request of the Government servant his seniority shall be placed below that of the last person in the cadre of the transferred unit or place in a Range/Commissionarate.

(2) Assistant Sub Inspector/Head Constable (Civil/CAR/DAR) or equivalent post

(i) The inter-district transfer request shall be considered after promotion of the all police men of equivalent rank and batch who are serving in the recipient district/unit before the joining date of the applicant.

(ii) By placing him below the last person in that cadre in the seniority list of the unit at the time of joining to which he is transferred.

(iii) Availability of vacancies.

(iv) Shall be holding equivalent post in the District/Commissionate.

(v) In cases where both husband and wife are in Government service and a request for transfer under these rules is made by a spouse, from a post in one unit of seniority in a Range/Commissionarate to an identical post in the same cadre in another unit of seniority in another Range/Commissionarate, the competent authority can consider the request for transfer subject to the following conditions, namely:-

(a) the Assistant Sub Inspector/Head Constable (Civil/CAR/DAR) must have satisfactorily completed the probationary period; and

(b) the provision of rule 16-A of and the general instructions that may be issued by the Government from time to time under the Karnataka Civil Services (General Recruitment) Rules, 1977 shall apply mutatis mutandis to such request for transfer.

(3) Police Constable: (Civil and CAR/DAR)

(i) Must of have completed minimum period of Seven years service.

(ii) He shall be placed below the last person in that cadre in the seniority list of the unit at the time of reporting/joining to which he is transferred.

(iii) In case of Ex-servicemen he should have completed minimum period of three years service and satisfactorily completed his probation period.

(iv) In cases where both husband and wife are in Government service and a request for transfer under these rules is made by a spouse, from a post in one unit of seniority in a Range/Commissionarate to an identical post in the same cadre in another unit of seniority in another Range/Commissionarate, the competent authority can consider the request for transfer subject to the following conditions, namely:-

(a) the Police Constable: (Civil and CAR/DAR) must have satisfactorily completed the probationary period; and

(b)the provision of rule 16-A of and the general instructions that may be issued by the Government from time to time under the Karnataka Civil Services (General Recruitment) Rules, 1977 shall apply mutatis mutandis to such request for transfer.

(v) Sanctioned post shall be vacant and available in the unit or place to be transferred in a Range/Commissionarate.

(iv) Such transfer shall not be permissible from one cadre to another cadre.

(v) Since the appointment being made at the request of the Government servant his seniority shall be placed below that of the last person in the cadre of the transferred unit or place in a Range/Commissionarate.

(4) First Division Assistant/Second Division Assistant/DALAYATHS AND OTHER GROUP ‘D’ EMPLOYEES:

(i) He shall be placed below the last person in that cadre in the seniority list of the unit at the time of reporting/joining to which he is transferred.

(ii) In cases where both husband and wife are in Government service and a request for transfer under these rules is made by a spouse, from a post in one unit of seniority in a Range/Commissionarate to an identical post in the same cadre in another unit of seniority in another Range/Commissionarate, the competent authority can consider the request for transfer subject to the following conditions, namely:-

(a) the F.D.A/S.D.A/DALAYATHS AND OTHER GROUP ‘D’ EMPLOYEE must have satisfactorily completed the probationary period; and

(b) the provision of rule 16-A of and the general instructions that may be issued by the Government from time to time under the Karnataka Civil Services (General Recruitment) Rules, 1977 shall apply mutatis mutandis to such request for transfer.

(iii) Sanctioned post shall be vacant and available in the unit or place to be transferred in a Range/Commissionarate.

(iv) Such transfer shall not be permissible from one cadre to another cadre.

(v) Since the appointment being made at the request of the Government servant his seniority shall be placed below that of the last person in the cadre of the transferred unit or place in a Range/Commissionarate.
