Section 77: Filing of suzts against kud1krdappukaran in ccrtam cases

If the kudlkidappukaran does not comply with the requisition made by the person in possession of the land under sub-section (2) of section 75 or 48 by the owner under sub-section (4) of that section to shift to a new site, the person in possession of the land or the owner, as the case may be, may institute a suit against lum for the purpose. The court, on being satisfied that such person has complied with all the conditions men~ tioned in sub-section (2) or sub-section ( 4) of section 75, may pass a decree for shiftmg the kudikidappu :

Provided that no such suit shall be instituted without giving the k.udikidappukaran one month's notice by registered post.
