(1) In addition to the requirements specified in sub-section (1) of section 5, the sponsoring body shall fulfil the following conditions and requirements, namely :– (A) Land.–
(a) For the State of Maharashtra excluding the Municipal Corporation areas of Mumbai and Thane.– The sponsoring body shall submit the title deeds, as provided in clause (b) of sub-section (1) of section 5 of the Act, of a contiguous piece of land as mentioned below :

Provided that, in case a sponsoring body managing renowned and eminent educational institutions with high grades of accreditation and providing high-quality education and where the proposal entails the formation of a university by bringing these existing colleges or institutions under its purview that do not belong to a contiguous piece of land and if the Government is satisfied that the university is required to be established for the interest of the State, the Government may allow such application and decide the same on its merits.
(b) For Municipal Corporation Area of Brihan Mumbai and Thane.– The minimum land required in the cities of Brihan Mumbai and Thane shall be four hectares. However, this minimum requirement of land can be relaxed on the following conditions :-
(i) the sponsoring body manages an educational institution with a valid Accreditation of the National Accreditation and Assessment Council (NAAC), Cumulative Grade Point Average (CGPA) of 3.25 or equivalent valid score by the National Board of Accreditation (NBA) or is within the 200 ranks of the latest National Institutional Ranking Framework (NIRF) ranking;
(ii) the land available for the proposed university is sufficient for constructing the required infrastructure as per the building construction norms of the Brihan Mumbai Municipal Corporation or the Thane Municipal Corporation, as the case may be;
(iii) there shall be no commercial stakeholders in the said building and no part of the building shall be used for commercial purposes;
(iv) there shall be scope for additional construction if the number of students increases.
(B) Infrastructure.-
(i) Minimum constructed area of 15,000 square meters that includes administrative (cabins and office space for the statutory officers, teaching, and nonteaching staff), academic buildings (classrooms, libraries, seminar halls, auditoriums, laboratories, computer centres) and ancillary buildings (reception, common rooms, etc.). Classrooms and other amenities for students in university should be as per the guidelines of the All India Council of Technical Education (AICTE), University Grants Commission (UGC) or other concerned regulatory bodies. While calculating the requirement of 15000 square meters area, the area of the hostels and sports complex will not be counted.
(ii) The sponsoring body shall make arrangements for the accommodation of students.
(C) Special provisions regarding interim campus.– A sponsoring body having impeccable credentials and proposing an innovative and state-of-the-art university where no infrastructure is available at the time of submission of the proposal in partnership with industries may request to set up the interim campus. The Government may evaluate the proposal on a case-to-case basis on the following conditions.-
(i) the constructed area available in the interim campus is sufficient for the administrative and academic requirements of the admitted students and, in any case, is not less than 5000 square meters;
(ii) the available infrastructure is as per norms laid down by the concerned regulatory body;
(iii) the sponsoring body shall shift the university from the interim campus to its intended permanent campus as mentioned in the Detailed Project Report (DPR) that fulfils the infrastructure norms mentioned in clause (B) above, within three years from the operationalisation of the interim campus;

(iv) on receipt of report of the Secretary Level Committee, Government shall publish a notification in the Official Gazette, allowing the operationalization of the interim campus;
(v) after shifting the interim campus to its intended permanent campus, the Secretary Level Committee shall visit permanent campus and verify compliance of the undertakings and requirements specified in the Letter of Intent. On receipt of report of the Secretary Level Committee, Government shall publish a notification in the Official Gazette, allowing the operationalization of the permanent campus.
