Section 5: Information to Child Marriage Prohibition Officer

(1) Any person, organization or educational institution who has reason to believe that a child marriage has been, or is being, or is likely to be solemnized or the child, himself or herself may give information through letter, e-mail or a telephone call or call on Child Helpline Number 1098 or in any other form, either in writing or orally, to the Child Marriage Prohibition Officer having jurisdiction in the area or any other Child Marriage Prohibition Officer.

(2) If any child is absent from school for a continuous period of more than fifteen days without any information to the school authorities, it shall be the responsibility of the School Principal or Head Master to find out the reason for absenteeism of such child and if it is due to child marriage, the School Principal or Head Master shall inform in Form II to the Child Marriage Prohibition Officer in whose jurisdiction the school is located.

(3) Upon receipt of information that a child marriage has been, or is being, or is likely to be solemnized, the Child Marriage Prohibition Officer shall prepare a Child Marriage Incident Report in Form I and submit the same to the Judicial Magistrate First Class or the Metropolitan Magistrate and forward copies thereof to the Police officer in charge of the Police station within whose jurisdiction the child marriage alleged to have been, or is being or is likely to be solemnized.

(4) Notwithstanding anything contained in these rules, the Child Marriage Prohibition Officer shall not refuse to record information regarding the child marriage on the ground that the child marriage alleged to have been, or is being or is likely to be solemnized outside the area of his jurisdiction. He shall record and pass such information immediately through email, telephone, mobile message or any other mode of communication to the concerned Child Marriage Prohibition Officer having jurisdiction.

(5) If a complaint regarding domestic violence is received by the Child Marriage Prohibition Officer, he shall send that information immediately to the concerned Protection Officer appointed under the Protection of Women from Domestic Violence Act, 2005 (43 of 2005).

(6) If a complaint regarding sexual abuse of the child who has been married or likely to be married is received by the Child Marriage Prohibition Officer, he shall mandatorily report it to the police as provided under section 19 of the Protection of Children from Sexual Offences Act, 2012 (32 of 2012).

(7) The Child Marriage Prohibition Officer shall give a copy of the Child Marriage Incident Report under his signature immediately to the informant, free of cost.

(8) The Child Marriage Prohibition Officer shall maintain the confidentiality of the identity of persons or organizations communicating information about child marriage to him. However, he may disclose identity of such persons or organizations to the concerned police officer if there is a danger to the life or the property of the person/s or organization giving such information.
