Section 28: Power of State Government to call for record, etc.

(1) The State Government may, if it is of the opinion that it is necessary or expedient so to do, call for and examine the record of any proceedings or decision or order of [the Chief Executive Officer] or of the Committee with a view to satisfy itself as to the legality of such proceedings or the correctness, legality or propriety of any decision or order made thereunder, and if, in any case, it appears to the State Government, that any such decision or order should be modified, annulled or reversed or remitted for reconsideration, it may pass orders accordingly:
[Provided that, the Chief Executive Officer may send such of the resolutions of the Committee to the Government which he thinks it necessary to be brought to the notice of the Government.]
(2) In a case where the record of any proceeding or [decision, resolution or order of the Chief Executive Officer] or of any Committee is called for by the State Government under sub-section (1), the State Government may stay the execution of any such [decision, resolution or order of the Executive Officer] or the Committee pending the exercise of its power under sub-section (1) in respect thereof :
Provided that, the State Government shall not pass any order under sub-section (1) unless the parties concerned are given an opportunity to render an explanation.
