Section 6: Procedure for hearing of complaints before Competent Authority

(1) On receipt of report from the Fact Finding Committee (FFC), if the Competent Authority is satisfied with the allegations made in the complaint, it shall issue a notice for hearing to the complainant and the concerned person or Educational Institution.

(2) The notice shall contain the particulars of alleged contravention of the provisions of the Act mentioned in the complaint and shall provide the details regarding time, date and place of the hearing.

(3) While conducting the hearing, the Competent Authority shall explain the details of alleged contravention of the provisions of the Act mentioned in the complaint to the concerned person or Educational Institution.

(4) The Competent Authority shall give a reasonable opportunity of being heard to all the parties and allow the complainant or the concerned person or Educational Institution to lead evidence in support of their contention.

(5) If the concerned person or Educational Institution pleads guilty, the Competent Authority shall record the same.

(6) If the concerned person or Educational Institution does not plead guilty and contests the charges, the Competent Authority shall allow to file their say in support of their contentions.

(7) If the Competent Authority, after considering the evidence, documents, other records and submissions of the parties, is satisfied that,—

(i) the person or Educational Institution has contravened the provisions of the Act, the Competent Authority shall pass an order in persuance of section 6 of the Act.

(ii) there is no substance and merit in the complaint, it shall pass an order in writing dismissing the complaint. The Competent Authority may impose a cost if deems fit.

(8) If any party fails, neglects or refuses to appear before the Competent Authority, it may decide the complaint ex-parte on the merit of the case.
