Section 312: Levelling and draining of private streets

If any private street or part thereof is not levelled, paved, metalled, flagged, channelled, sewered, dranined, conserved or lighted to the satisfaction of the Municipality, it may by a written notice, require, the owners of the such street or part thereof and the owners of the lands and the buildings fronting or abutting on such street or part thereof, to carry out any work which, in the opinion to the Municipality, may be necessary and within such times, as may be specified in such notice.

2. If the work is not carried out within the time specified in the notice, the Municipality may, if it thinks fit, get the work executed and the expenses incurred for the purpose, shall be paid by the owners referred to in subsection (1) in such proportion, asmay be determined by the Municipality and shall be recoverable for them as an arrears of tax under this Act.
