Section 313: Right of owners to require streets to be declared public

The Nagaland Municipal Act,2001State Act of Nagaland · Act 10 of 2001

1. If any street has been levelled, paved, metalled, flagged, channelled, sewered, drained, conserved and lighted under section 312 to the satisfaction of the Municipality, the Municipality may, and, on the requisition of a majority of the owners referred to in sub-section (1) of the sections shall declare such street to be a public street and thereupon the street shall vest in the Municipality.

2. The Municipality may at any time, by notice fixed up in any street or part thereof not maintainable by the Municipality but which has already been levelled, paved, metalled, flagged, channelled, drained, sewered, conserved and lighted to the satisfaction of the Municipality, give intimation of its intention to declare the same a public street and unless within one month, next after such notice has been so put up, the owner or any one of the several owners of such street or such part of a Street, lodge objection thereto at the office of the Municipality may, by notice in writing, put up in such street or such part, declare the same to be a public street vested in Municipality.
