Section 28: Penalty for default in registration

(1) Any person carrying on the business of a dealer, hotel-keeper or travel agent without a proper registration under this Act or in violation of the provisions of this ACT or 'RULES' shall be punishable by the prescribed authority with a fine'which may extend top Rs. 5000 and if the breach is a continuing one, with a fine of Rs. 100 for each such day.

(2) The fine imposed under sub-section (1) shall be recovered as if it is an arrears of public revenue due on land under the provisions of the Bengal Public Demands Recovery Act. 19 13.

Explanation - Aperson who has made an application with the prescribed period and is pending disposal shall not be defaulter for the purpose of this section.

29. Penalty for false statement- If any person required to make a statement under this Act willfully makes a false statement or suppresses a material fact with an intention to mislead the prescribed authority, he shall be liable to punishment with imprisonment, for a term which may extend to three months or with fine not exceeding Rs 1000 or with both.
