Notwithstanding anything contained in the Indian Evidence Act, 1872, when any complain under this Act is made in writing by an person to the prescribed authority, it may b admitted in evidence and the examination of the complainant shall not be obligatory in any trial by a Judicial Magistrate, if such person cannot be found or is incapable of giving evidence.
36. Institution of proceedings- No prosecution shall be instituted against any person for any offence under this Act except on a complaint made by the prescribed authority.
