Section 53: Suit or proceeding by or against

The Odisha Court of Wards Act, 1947State Act of Odisha · Act 26 of 1947

(1) In all suits or proceedings in any Civil or Revenue Court the wards shall sue and be sued in his own name and the manager of his property appointed under Section 26 or, if there is no such manager, the officer competent to act as manager under Section 27 shall represent him, as next friend or guardian ad litem, as the case may be.

(2) The Court of Wards may, by an order, nominate or substitute any other person to be next friend or guardian for any such suit or proceeding; and upon receiving a copy of any such order, the Civil or Revenue Court in which such suit or proceeding is pending shall substitute the name of the next friend or guardian for the suit or the proceeding so appointed for the name of the manager or Collector.
