Section 52: Notice of suits

The Odisha Court of Wards Act, 1947State Act of Odisha · Act 26 of 1947

(1) No suit relating to the person or property of any ward shall be instituted in any Civil Court until the expiration of two months after notice in writing has been delivered to or left at the office of the Collector specified in the notification under Section 21 or the Collector appointed under Section 50, as the case may be.

(2) Such notice shall state the name and place of abode of the intending plaintiff, the cause of action and the relief which he claims ; and the plaint shall contain a statement that such notice has been so delivered or left :

Provided that notice under this section shall not be required in the case of any suit the period of limitation for which will expire within three months from the date of the notification under Section 21.
