Section 7: Manner of taking possession of public premises

Public Premises (Eviction.of Unauthorised Occupant) Rules,1971Central Rules · 1971

21(1) If any obstruction is offered, or is in the opinion of the estate officer likely to be offered-

(a) to the taking possession of any public premises; or &) to the sealing of erection or work or of the pubiic premises, under the said Act, the estate officer or any other offiier duly authorised by him in this behalf may obtain necessary police assistance:

Provided that no sealing or taking possession of the unauthorised construction shall be made before sunrise or after sunset.]

(2) Where any pubiic premises of which possession is to be taken under the Act is found locked,.the estate officer or any other officer drly authorised by him in tlds behalf may either seal the premir*i .it in the pt"ru*." of fwo witnesses break open the locks or open or cause to be opened any door, gate or other banier and enter the premises:

1[(3) The sealing under sub-section (1) of section 5C of the Act shall be made in the following manners, namelY:-

(t) affixing the office seal on outer door or any erection or work of any public-premises after all other outlets and inlets to the erection or work ot public premises have been properly bolted, locked or encircled with tope, wire or wire mesh; .

(it) where doors and windows have not been fixed to any_ erection or work or public premises or where the erection of work on public premises is of such a nature that it cannot be encircled with'ropg, ryire bt *it"-*esh in that case such erection or work or public pr€mises shall be covered, by wooden planks, iron or ce'ment sheets and'.office seal affixed in a manner thai no person can enter into or updn the 'brection or work or publicpretnisei without tampering 1" oTt:"
