(1) The State Government may, as soon as Et br h t may be, by notification establish a Council to be cin!tit~ti~n ant called, "The Council of Homoeopathic System of i?corp_oration o Medicine, '[* * *] for the purpose of carrying out council.

(2) The Council shall be a body corporate with the name aforesajd. having perpetual succession and a common seal with power to acquire, hold and dis pose of property. and to contract. and may by that name sue and be sued.
(3) The Council shalI consist of eleven members re~dding in Punjab of whom-
(a) three members shall be nominated by the State Government one of them, if possible, being a person connected with such insti tutions as are referred to in Schedule T :
and
(b) ehtht members, of whom not less than four shall be persons holding a degree, aiploma or certificate in the Homoeopathic System.

(4) The Chairman of the Council shall be nomi nated by the State Government from amongst the members and shall hold office during the pleasure of the State Government.
(5) The eight members mentioned in clause (b) of sub-section (3) shall in the case of '[the first Coun cil to be constituted after the commencement of tilt:

be nominated by the State Government from amongst the practitioners who are eligible to be registered practitioners, and such members shall be deemed L;J have been duly elected under clause (b) of sub-section (3) : /
Provided that not less than four of such members shall be persons holding a degree, diploma or certi ficate in Homoeopathic System from such institutions as are referred to in Schedule I.
(6) Every election or nomination of member and every vacancy in the office of a member shall be noti fied by the State Government in the Official Gazette.
Election of 4. The election of practitioners entitled to be members. members of the Council under clause (b) of sub-sec tion (3) of section 3 shall be held at such time and place and in such manner as may be prescribed.

in that sub-section, nominate such registered practitioner as it deems fit, and the practitioner so nominated shall for the purposes of this Part be deemed to have been duly elected under that clause.
