Section 7: Grant of License

The Rajasthan Forest Produce (Establishment & Regulation of Saw Mills) Rules, 1983State Rules of Rajasthan · 1953

(i) Any owner of an existing saw mill or of a saw mill in respect of which a permit granted under rule 4 is effective, shall make an application in a prescribed form to the licensing officer for grant of license for carrying on sawing operations in that saw mill.

(ii) On receipt of such an application, the licensing officer may grant a license on such conditions after making such enquires in such a manner as may be expedient in this behalf.

6 1[(iii) The license so granted shall be non-transferable. However, transfer of saw mill license can be allowed from one person to another by the 2(Chief Conservator of Forests of the area concerned) in cases of transfer of saw mill by sale, inheritance, division of property, family arrangement and dissolution of partnership. But relocation of saw mill outside the district shall not be permitted in any case.

(iv) The license shall be granted initially for a period of five years and thereafter renewed by the licensing officer on an application made by the licensee to this effect for every subsequent five years. Such application shall be made at least three months before the expiry of period of license. The licensee shall have to pay license fee afresh. In case licensee fails to submit his application for renewal within the stipulated period and submit application for renewal after expiry of stipulated period but within three month of expiry of the license, the licensing authority may consider renewal of license on payment of fee equal to double the prescribed fee. If licensee does not apply for a renewal of license within three months after the expiry of the license, renewal of license shall not be considered.]

3[Provided that the licensee, who failed to submit his application for renewal within the six months from the date of commencement of the Rajasthan Forest Produce (Establishment and Regulation of Saw Mills) Amendment) Rules, 2012 and the licensing authority may consider renewal of license for subsequent five years on payment of fee equal to triple the prescribed fee and if any licensee whose license was not renewed and he fails to submit application for renewal within a period of such six months, his license shall be deemed to be cancelled.]
