(1) The claim for compensation under sub-section (2) of section 16 shall be made within a period of one month from the date on which the permission granted under section 15 is revoked or modified by the appropriate authority. The owner shall file his claim of compensation in writing with sufficient documentary evidence to prove that the expenditure incurred by him in carrying out any development in accordance with the permission granted has been rendered abortive by revocation or modification of such permission, 3 lL
(2) If the owner does not accept the compensation fixed by the appropriate authority under sub-section (3) of section 16, he may give a notice to the appropriate authority or to the authorised officer, as. the case maybe, within fifteen days from the date of the order by which the compensation is communicated to him stating that he refuses to accept the compensation.
(3) On receiving notice within the time stipulated under sub-rule (2) above, the appropriate authority shall refer the matter for adjudication to the Commissioner concerned
Explanation: For the purpose of this sub-rule, “Commissioner” means the Commissioner appointed under section 17 of the Rajasthan Land Revenue Act, 1956 (Act No.15 of 1956) for a division.
