Section 68: Declaration of results

When the counting of votes has been completed the returning officer shall prepare a return of the results of the polling wardwise in Form 22 and shall declare the results in the following manner unless otherwise directed by the State Election Commission.

(a) The candidate who is found to have obtained the largest number of valid vote shall be declared to have been elected.

(b) If after the counting of votes, an equality of votes is found to exist between any candidates and the addition of one vote will entitle any of the candidate to be declared elected, the returning officer shall forthwith decide between these candidates by lot drawn in the presence of such candidates or their election agents and the candidate on whom the lot falls shall be considered to have received an additional vote and shall be declared duly elected.
