When a convicted criminal mentally ill prisoner cannot be transferred to a mental health care centre before his or her sentence expires, he or she shall be detained in prison and on the expiry of his or her sentence, he or she shall be treated as non-criminal mentally ill prisoner and handed over to his or her family or referred to the District Magistrate.
