(1) A 35 [collective investment scheme] shall be constituted in the form of a trust and the instrumentof trust shall be in the form of a deed duly registered under the provisions ofthe Indian Registration Act, 1908 (16 of 1908) executed by the CollectiveInvestment Management Company in favour of the trustees named in suchan instrument.
