(1) The employer of every motor transport undertaking who has obtained a certificate of registration under rule 5 shall submit to the Inspector of Labour having jurisdiction, an application in Form No. I in duplicate for the renewal of the registration certificate. An application for renewal shall be made not less than 30 days before the date on which the certificate of registration expires and shall be accompanied by the original certificate, if it is not already available with the Inspector of Labour and the original treasury receipt for payment of the prescribed fee for such renewal.
(2) The fees payable for renewal of certificate of registration shall be as specified in the Table under sub-rule (4) of rule 4:
Provided that if the application for renewal is not sent within the time specified in sub-rule (1) 1[***] an additional fee of twenty-five percent. of the fee ordinarily payable for the certificate of registration shall be payable for such renewal:
Provided further that in cases where the Chief Inspector or the Inspector of Labour concerned is satisfied that delay in submission of the application is due to unavoidable circumstances beyond the control of the employer, he may reduce or remit, as he thinks fit, the payment of such excess fee.
(3) If the application has been made in accordance with this rule, the undertaking shall be deemed to be duly registered until such date as the Inspector of Labour concerned may pass orders on the application for renewal of the registration.
