Section 39: Appeal to be in writing

( 1) Every appeal under sub—section (5) of section 44 or sub-section (1) of section 45 shall either be presented in ‘ person or sent b re ste d to the appellate authority.

(2) The appeal shall be made in the form of a metmgrgndum and shall be accompanied by the original or a ce 1 e copy of the order appealed a ai t out in the schedule;

(3) Every appeal shall;

(a) specify the name and address of the appellant and also the name and address ofthe respondent;

state by whom the order appealed against was made;

(c) setforth concisely and under distinct heads, the grounds of objection to the order appealed against With a memorandum ofevidence;

(d) state precisely the relief which the appellant claims; and

(e) give the date of the order appealed against.
