Citizen having applied for such services shall be entitled to seek conpensalory cosl in a.co.dance winr tlre provisions of this Act and rules made ther€under, in case of delay or defadt in the delivery ofsuch seflices b€yond the stipulated lime.
9. Liability to pay compensstory cost- Every Appeuate Authority or Competent Offcer or designat€d officer or his subordinale public servant who fails to deliver or dispose the citizen related seNices or appeals ofa citizcn \yitlin the stipulated time shall be liable 10 pay compensatory cost at the rate oftventy rupe€s pe. day for the period of delay subject to a nra\intm of five hundred rLpees pe. application , in aggregate, if there is no ban or reshctiorl from ihe Government to provide tle same.
Providiry thar the payment of compensatory cosl for delay in disposing of apptications coutd not be imposed on folLowin| grounds: - i) Mater pending or delayed because oflitigatio.
ii) Applicants intention is to eam profit ftom tlre compensatory cost iii) The seNice applied required is ool needed by him at thal pointoftime iv) There is nmrifold increase in applications.
v) Delayed because ofdisaster, breakdown ofnehvork Load shedding.
Provided €very Departnent shall ensure thal that there are adequate slafi for processing and d€livery of services.
