Section 7: Provide Fund and pension

(1) Persons appointed as Chairman and Vice-chairman shall be governed by the Contributory Provident Fund Scheme operated by the Commission:

Provided that if a person who was in pensionable employment is appointed as: Chairman or Vice-Chairman, he shall be allowed, at his option, to count his previous service upto the normal age of superannuation for pension and retirement benefits under the previous employer subject to the condition that the previous employer shall discharge its pensionary liability by paying in lumpsum as a one time payment the pro-rata pension, service gratuity, terminal gratuity and Death-cum-retirement Gratuity for the service upto the date of his joining Commission. Chairman and Vice-Chairman shall not eligible for pension or pensionary benefits after attaining the age of superannuation, but shall be eligible to the contributory Provident Fund Scheme of the Commission on the same terms and conditions as are applicable to other re-employed employees of the Commission.

(2) Except in respect of matters for which specific provisions have been made, the rules, regulations, orders, instructions and procedures as applicable to the employees of the Commission in respect of all matters relating to the operation of the Contributory Provident Fund Scheme or the Pension–cum–Gratuity and General Provident Fund Scheme, as the case may be, shall apply mutatis mutandis to the Chairman and the Vice-Chairman.

Such matters shall include the conditions for counting past service for purpose of pension, transfer of pension liability and Provident Fund contributions of Past service, the Applicable age of superannation for purpose of pension, rates of contribution to and employer’s share and rates of interest thereon in the Provident Fund accounts and other details.

(3) For the Period of their tenure of office after attaining the normal age of superannuation as applicable to employees of the Commission, the Chairman and the Vice-Chairman shall be entitled to the Benefit of the Schemes refered to in this rule, only to the extent they are applicable to re-employed pensioners in the Commission.

8. Leave

(i) The Chairman nnd the Vice-Chairman shall be entitled to Earned leave on full pay at the rate of 30 days in a calendar year. Tho leave shall be credited to his account in advance in two half-yearly instalments of 15 days each on the first day of January and first day of July every year:

Provided that if the Chairman or the Vice-Chairman assumes or relinquishes charge of the office during the currency of a half year, leave at the rate of two and a half days for each completed month of service shall be credited to his account.

(ii) The leave at the credit of the Chairman and the Vice-chairman at the close of the previous half-year shall be carried forward to the new half-year, subject to the condition that the leave so carried forward plus the credit for that half year does not exceed the maximum limit of 240 days.

(iii) The Chairman, or Vice-Chairman on relinquishing the charge of his office shall be entitled to receive a sum equivalent to the leave salary admissible for the number of days of leave on full pay including all allowance’s due to him at the time of his relinquishment of charge subject to a maximum of 240 days.

(iv) The Chairman and Vice-chairman shall also be entitled to half pay leave at the rate of 20 days for each completed year of service. This half pay leave may only be availed of as commuted leave on full pay on medical certificate. When commuted leave is aval led, twice the amount of half pay leave shall be debited against half pay leave due.

(v) Chairman and the Vice-Chairman shall to avail extra-ordinary leave without maximum period of three months during full medical medical grounds.
