The Uttar Pradesh Agricultural Produce Market Committees (Centralised) Services Regulations, 1984State Regulations of Uttar Pradesh · 1964

(1) Except as hereinafter provided, the seniority of persons in any category or grade of posts in the Centralised Service shall be determined from the date of the order of substantive appointment and if two or more persons are appointed together, by the order in which their names are arranged in the appointment order:

Provided that if the appointment order specifies a particular back date with effect from which a person is substantively appointed, that date, will be deemed to be the date of order of substantive appointment and, in other cases, it will mean the date of issue of the order.

(2) The Seniority interse of persons appointed directly on the result of any one selection, shall be the same as determined by the Selection Committee

Provided that a candidate recruited directly may loose his seniority if he fails to join without valid reasons when vacancy is offered to him, the decision of the appointing authority as to the validity of reasons shall be final

(3) The seniority interse of persons appointed by promotion shall be the same as it was in the cadre from which they were promoted.

(4) Where appointments are made both by promotion and direct recruitment, the inter-se-seniority shall be determined by arranging the names in a cyclic order in a combined list. prepared in accordance with regulation 18, in such manner that the prescribed percentage is maintained.

(5) Government servants serving on deputation on a post or grade in a cadre, who have been found suitable and become a member of the service under regulation 19 shall rank senior to those appointed to that post or grade in the cadre after the coming inte force of these regulation.

The inter-se-seniority of such servants shall be the same as it was in their parent department.

(6) Besides maintenance of seniority list of each category of posts in the service by the appointing authority concerned, a combined seniority list of such categories of officers as are eligible for promotion to the post of secretary of the market Committee shall be maintained at the Board's level also.

Transfer of Members of the Services

24.

1[(1) A member of contralised service [other than the employees mentioned in sub-regulation (2)) may be transferred from one Market Committes to another Market Com-mittee in the region by the order of the Director, or Additional Director or the Regional Deputy Director (Administration) and from one region to another region by the order of the Director or the Additional Director. The transfer travelling allowances of members of the centralised service shall be borne by the Market Committees to which he is transferred.

2[(2) The regional Deputy Director (Administration/Marketing) may transfer any member of the service holding the post of Group "D" from one Market Committee to another within the region and the Director or the Additional Director on the basis of mutual request or proven misconduct through proceedings as per rules can transfer them from one region to another.]

(3) On transfer, the member of the service shall be entitled to travelling allowances as admissible to the State Government employees in the corresponding scale of pay.

PART VI Paying Authority.

25. Subject to the provisions of these regulations the pay and allowances of persons appointed to the Certralised Service shall be paid by the Market Committee in which such persons is for the time being posted.
