(1) Subject to the provisions of sub-regulation (2) these regulations shall apply to all employees who are in the service of the Board.
(2) Employees on deputation and on contract shall be governed by the term and conditions of their deputation or contract.
CHAPTER-II Strength of the Officers and Staff 1[4. (1) The strength of the officers and staff and of each category of posts therein and the scales of pay shall be such as may be determined by the Board from time to time.
Provided that scales of pay shall be such as may be recommended from time to time by the Pay Commission and approved by the State Government.]
(2) The present strength of the officers and staff and of each category of posts therein and the scales of pay shall, until orders varying the same are passed, be as given in the Appendix ‘A’ to these regulations.
Provided that-
(a) The appointing authority may leave unfilled or the Board may hold in abeyance any vacant post or posts without thereby entitling any person to compensation or other redress.
(b) The Board may create such additional permanent or temporary posts from time to time as may be found necessary and may change the nomenclature of the existing posts.
CHAPTER III-GENERAL CONDITIONS OF RECRUITMENT Classification of posts 1 Substituted by The Uttar Pradesh Agricultural Produce Markets Board (Officers And Staff Establishment) (Sixth Amendment) Regulations, 2010.
5. Posts under the Board shall for purposes of appointment control, and discipline, etc. be classified in classes A, B, C, and according to the pay scales as per classification of posts under the State Government in force from time to time.
Age
6. Age limits for the candidates for direct recruitment to different classes of posts in the service shall be as prescribed for recruitment to posts under the State Government.
Provided that the upper age limits for employees of the Board shall be greater by five year or the number of years they have put up in the Board, whichever is less.
Qualifications
7. The minimum educational qualifications, preferential qualifications and experience prescribed for the various posts to be filled in by direct recruitment shall be as in Appendix 'B'.
Nationality-Character, Physical fitness. Marital Status, Reservation
8. Rules regarding Nationality, Character, Physical fitness, marital status and reservation for recruitment to different class of posts as applicable for recruitment to posts under the State Government shall apply to recruitment under the Board.
CHAPTER IV-Recruitment and Appointment Appointing Authority
9. The authority or the officers shown in column 1 of the table below shall be the appointing authority in respect of the posts shown in column 2 of the table, Column. 1 Column. 2
1. Board All posts in Group A (except the Director and the Additional Director and Finance Controller).
2. Director All post in class B posts
3. Additional Director All post in class C posts
4. other decisions on service matters of all posts in Group ‘A’ held by officers of Mandi Parishad, shall be delegated to the director of Mandies.]
Source of Recruitment 1[10. (1) The posts shall be filled
(a) by direct recruitment;
(b) by promotion of Parishad employee,
(c) by Deputation or Contract basis but post of Director, Additional Director and Finance Controller shall be filled by deputation.
Note- The Director shall be an officer in the super time scale of the L.A.S.. the Additional Director shall be an officer in the selection grade of the State Civil Service (Executive Branch) and Finance Controller shall be an officer in special pay scale of State Finance Services..
(2) (a) All the posts in Group-A except the post of Director, Additional Director and Finance Controller shall be filled by promotion and the posts of Deputy Director (Administration/Marketing) shall be filled by promotion as indicated below :-
1. Ten posts from Mandi Secretary Cadre. The criteria for selection shall be seniority subject to rejection of the unfit.
2. Two post from the post of marketing officer cadre. The criteria for selection shall be seniority subject to rejection of the unfit.
3. One post from the post of Publicity Officer One time and after that from the post of Marketing Officer by selection on Seniority subject to rejection of the unfit.
4. One post of Deputy Director (Administration/Marketing) Head Quarter and other post of Deputy Director (Administration/Marketing) by State PCS Service Officer on Deputation.
(b) 50 percent post in Group 'B' shall be filled by promotion and 50 percent by direct recruitment provided that posts of Private Secretaries Grade-2 shall be filled by promotion.
2[(c) Lowest Grade in Clerk Cadre in Group C shall be filled as follows-
1. 80 percent posts by direct recruitment.

2. 15 percent posts by promotion from Group D employees who have passed High School or equivalent examination.
3. 5 percent post by promotion from Group D employees who have passed Intermediate or equivalent examination, also completed 5 year continuous service in Group D post on merit basis.]
(d) All the posts in the scale of pay above the lowest grade in Group C shall be filled by promotion provided that posts of Legal Assistant, Assistant Programmer and Driver shall be filled by direct recruitment.
(e) All the posts in Group D shall be filled by direct recruitment.
(3) Any post required to be filled by direct recruitment or promotion may in the discretion of the Board, be filled by taking persons on deputation.
(4) Promotion shall be confined to the posts within the same group as detailed in Appendix 'C' and shall be subject to the conditions eligibility for promotion to different posts as mentioned therein.]
