The Uttar Pradesh District Mineral Foundation Trust Rules, 2017State Rules of Uttar Pradesh · 1957

(1) These rules may be called the District Mineral Foundation Trust Rules, 2017.

(2) They shall apply to all minerals except mineral oil.

(3) They shall be deemed to have come into force on the 12th day of January, 2015.

Definitions 32. (1) In these Rules, unless the context otherwise requires, -

(a) 'Act' means the Mines and Minerals (Development and Regulation) Act, 1957, as amended from time to time;

(b) 'Affected area' means-Directly affected areas and indirectly affected areas as specified in rules 2A and 2B;

(c) Affected people shall include directly affected persons as specified in rule 2C;

(d) 'Fund' means the Fund of a Trust;

(e) 'Government' means the State Government of Uttar Pradesh;

(f) 'Holders of concessions' means any holder of mining lease, prospecting licence or mining permit granted under the provisions of the Act and the rules made thereunder;

(g) 'Minerals' and 'Minor minerals' means such minerals as defined in section 3 of the Act;

(h) 'Rules 2021' means the Uttar Pradesh Minor Minerals (Concession) Rules, 2021;

(i) 'Schedule' means a Schedule to the Act;

(j) ‘Trust' means 'District Mineral Foundation' Trust notified in Government notification no.489/86-2017-132-2016, dated April 25,2017;

(k) 'Trust Deed' means the deed executed by State Government in favour of the Trustees;

(l) Trustee/Trustees' means the person/persons appointed by the State Government for the purpose of governing the Trust;

(2) Words and expressions not defined in these rules shall have the same meaning as assigned to them under the Act and Rules of 2021.

Directly affected 2A. (1) Directly affected areas Shall be, - 2 areas

(a) Villages and gram panchayats or Urban Local Bodies (ULBs) within which the mines are situated and are operational. Such mining areas may extend to neighboring village/town/ block within district;

(b) An area within such radius from a mine or cluster of mines as may be specified by the State Government:

Provided that directly affected area shall not extend beyond 15 km from the boundary of the mines of minerals;

(c) Villages/wards in which families displaced by mines have been resettled/rehabilitated by the project authorities;

(d) Villages/wards that significantly depend on the mining areas for meeting their economic needs and have usufruct and traditional rights over the project are as, for instance, for grazing, collection of minor forest produce etc.

(2) The District Mineral Foundation (DMF) shall prepare and maintain an updated list of such directly affected areas.
