(1) Indirectly affected areas shall be, -
(a) those areas where local population is adversely affected on account of economic, social and environmental consequences due to mining-related operations of minerals.
The major negative impacts of mining could be by way of deterioration of water, soil and air quality, reduction in stream flows and depletion of ground water, congestion and pollution due to mining operations, transportation of minerals, increased burden on existing infrastructure and resources;
(b) an area beyond the directly affected area and within such radius from a mine or cluster of mines as may be specified by the State Government, but not more than 25 km from boundary of mines of mineral.
(2) The District Mineral Foundation (DMF) shall prepare and maintain an updated list of indirectly affected areas.
Affected people 2C. (1) Affected people shall include, - directly affected persons who shall be,
(i) 'Affected family' as defined under section 3(c) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no.30 of 2013);
(ii) 'Displaced family' as defined under section 3(k) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Ad, 2013 (Act no.30 of 2013);
(iii) any other people as appropriately identified by the concerned gram Sabha/Urban Local Bodies (ULBs) in directly or indirectly affected areas.
(b) persons affected by mining who have legal and occupational rights over they land being mined; people with usufruct and traditional rights; and those people whose lively hoods have been affected due to mining.
(2) Affected families shall be identified, as far as possible, in 3 2Second Amendment Dated 17.08.2021 and 3Third Amendment Dated 29.09.2025 consultation with local/elected representatives of gram Sabha/Urban Local Bodies (ULBs) in directly or indirectly affected areas.
(3) The District Mineral Foundation (DMF) shall prepare and maintain as updated list of such affected people/local communities. The list shall be revisited for updation at least once every 5 years."
Objectives of the trust
3. The objectives of the trust will be:-
(i) To work for the interest and benefit of persons and areas affected by mining operations or other related activities and transportation of minerals;
(ii) To utilize the funds collected in the District Mineral Foundation for the benefit of affected person or areas;
(iii) To utilize the funds on the advice of concern Gram Panchayat to develop the village road, watering place and other general facilities.
Composition and Management of the Trust 2 & 3 4. The Composition and management of the Trust shall be: -
(1) The trust shall consist of a Governing Council and a Managing Committee.
(2) The authority to manage the trust shall vest in the Governing Council.
(3) The governing Council shall consist of, -
(a) District Officer / Collector- Chairperson;
(b) Divisional Forest Officer- Ex-officio Member;
(c) Chief Medical Officer - Ex-officio Member;
(d) Executive Engineer, Public Work Department - Ex-officio Member;
(e) District Basic Education Officer- Ex-officio Member;
(f) District Panchayati Raj Officer- Ex-officio Member;
(g) District Mines Officer - Ex-officio Member Secretary;
(h) Two Mining Leaseholders nominated by District Officer - Non-official Member,
(i) One representative of the implementing agencies using the minerals, if any, as nominated by District Officer- Non-official Member,
(j) Representatives of the directly affected areas as nominated by District Officer Non-official Member.
(k) (i) In case of one Member of Parliament (MP) in the Lok Sabha in a district, MP shall be a member of Governing Council.
In case there is more than one MP of Lok Sabha in a district all MPs having mining affected areas as part of their constituency shall be member of the Governing 4 Council.
In case constituency of one MP of Lok Sabha falls in more than one district, MP shall be member of Governing Council of all such districts where mining affected area is a part of his/her constituency.
(ii) Member of Parliament in Rajya Sabha from the State shall be the member of Governing Council of one district selected by him/her.
The Member of Parliament in Rajya Sabha shall intimate name of the district selected by him/her to the Secretary in-charge of the mining department of the State, who in turn shall inform about the same to be concerned District Magistrate.
(iii) The Members of Legislative Assembly (MLAs) of the district having mining affected area as part of their constituency shall be the member of Governing Council.
(iv) The Members of Legislative Council of the State (MLC) shall be a member of Governing Council of one district selected by him/her.
The MLC shall intimate name of the district selected by him/her to the Secretary in-charge of the mining department of the State, who inturn shall inform about the same to the concerned District Magistrate.
(4) The tenure of a non-official member shall be for three years.
(5) Ex-officio member shall cease to hold office when he/she ceases to hold the Government post.
(6) The day-to-day functioning of the Trust shall vest in the Managing Committee.
(7) (a) The Managing Committee shall consist of, -
(i) District Officer/Collector- Chairperson;
(ii) Additional District Officer (Finance and Revenue) - Ex-officio Member;
(iii) One of the Sub-Divisional Magistrate as nominated by District Officer- Ex-officio Member;
(iv) District Mines Officer - Ex-officio Member Secretary;
(8) The tenure of the Ex-officio member of the managing committee shall end when he/she ceases to hold the Government post.
