Section 13

The Uttar Pradesh Inland Waterways Authority Rules, 2025State Rules of Uttar Pradesh · 2023

(1) The Vice-Chairperson shall, -

(i) assist the Chairperson in the discharge of his functions;

(ii) attend every meeting of the Authority unless prevented by sickness or other reasonable cause;

(iii) exercise the powers and perform the duties of the Chairperson subject to any such conditions and restrictions as may be specified by the State Government if the Chairperson is by infirmity, or otherwise, rendered incapable of carrying out his dutics or is absent, on leave or otherwise, in circumstances not involving the vacation of his office.

CHAPTER IV Procedure for Authority Meetings ::;?::yof : 14.(1) A meeting of the Authority other than a special meeting referred to in rule 14, shall be held at least once in every quarter of a calendar year.

. (2) The Chairperson shall, from time to time, detenpine the date and time of meetings of the Authority.

(3) A meeting of the Authority shall be held at headquarters of the Authority, or such other place as may be decided by the Authority in consultation with the State Government. . ) Calling of special 15. The Chairperson, or in his absence the Vice-Chairperson, may wherever TecHRgs: he thinks fit, and shall upon the return request of not less than three members, call a . special meeting of the Authority.

Notice of meeting 16. (1) A meeting of the Authority other than a special meeting referred to : in rule 15 shall be called by giving each member not less than seven clear days’ notice in writing, and each member shall be furnished a list of business to be disposed in that meeting.

(2) A special meeting shall be called by giving each member not less than three clear days’ notice in writing. ’ Quorum 17.(1) The quorum for meeting of the Authority other than special meeting shall be at least five members.

(2) Four members present shall be the quorum for special meeting of that Authority. i

(3) If, within half an hour from the time appointed for holding a meeting of the Authority, quorum:is not piescnt, the meeting shall be adjourned to the same day in the following week at the same time and place and the presiding officer of such meeting shall inform the members present and send notice to other members.

i (4) If at the adjouméd meeting, also, quorum is not present within half an hour from the time appointed for holding the meeting, then members present shall be the quorum.

Presiding at 18. The Chairperson, or in his absence the Vice-Chairperson, shall preside at mestings every meeting of the Authority, and if both the Chairperson and the Vice-Chairperson are not present the senior most member of the Authority present shall preside over the meeting.

(1) Minutes of the proceedings at each meeting of the Authority shall be recorded in a book to be provided by the Authority for this purpose which shall be signed as soon as practicable by the presiding officer as well as all members present in such meeting, and shall be open to inspection by any member during office hours.

(2) Minutes of the proceedings excepting such portion thereof, as the Chairperson or, in his absence the Vice-Chairperson, may direct in any particular case, shall also be open to the inspection of the public at the headquarters of the Authority during office hours.

) (3) The names of the members present at each meeting shall be recorded in the minutes book.

(4) A member present at any meeting of the Authority shall sign his name in a book or register to be provided by the Authority for the purpose.

8 CHAPTER-V " Advisory Committees and Empanelment of Experts

2. (1) The Authorit i i i A ly may constitute such Advisory Committees as may be necessary for the efficient discharge of its functions.

(2) The Advisory Committee may have official as well as non-official :;;bz:.ehc:ing qualifications and experiences related to shipping and navigation and (1?) An Advisory Committee shall not have more than six members, at least half of which shall be non-official members.

(4) The Authority will appoint one member as Head of the Advisory Committee.

23.(1) The Head of the Advisory Committee will call meeting of the Advisory Committee as and when required, or as directed by the Chairperson/Vice- Chairperson of the Authority.

(2) The quorum for a meeting of the Advisory Committee shall be not less than half of the total number of members of the Advisory Committee.

(3) Subject to sub rule (2), the meetings of any of the Advisory Committee shall, as far as may be, be governed by the rules, applicable to the meetings of the Authority specified in Chapter- IV.
