The Uttar Pradesh Inland Waterways Authority Rules, 2025State Rules of Uttar Pradesh · 2023

(1) If the Transport Minister, Uttar Pradesh is nominated by the Chief Minister as the Chairperson, then no separate facilities like traveling allowance, joining time and joining time pay etc. will be given to the Transport Minister for working as the Chairperson of the Authority.

(2) The Chairperson (if an expert person is appointed by the Chief Minister of Uttar Pradesh) and the Vice-Chairperson shall be entitled to such travelling allowance, joining time and joining time pay while proceeding to join duty on their initial appointment and on reversion therefrom as are admissible to the highest category of officers in the whole time employment of the Authority in accordance with the regulations applicable in that behalf: :

Provided that in the absence of any such regulations made by the Authority in that behalf, the traveling allowance, joining time and joining time pay in respect of officers of the State Government of and above the rank of Principal Secretary.

9.(1) If the Transport Minister, Uttar Pradesh is nominated by the Chief Minister for the post of Chairperson, then no separate facilities like traveling allowance, daily allowance erc. will be given to the Transport Minister for working as the Chairperson of the Authority.

(2) The Chairperson (if an expert person is appointed by the Chief Minister of Uttar Pradesh) and the Vice-Chairperson shall be entitled to draw such travelling allowance and daily allowance as is admissible to the highest category of officers in the whole- time Employment of the Authority in accordance with the regulations of the Authority applicable in that behalf:

Provided that, until such time regulations are made by the Authority in that behalf the travelling and daily allowance for journey on tour shall be regulated in accordance with the rules or orders made by the State Government for regulation of travelling by officers of the State Government of and above the rank Principal Secretary.

10. Other allowances and conditions of service of the Chairperson (if an expert person is appointed by the Chief Minister of Uttar Pradesh) and the Vice-Chairperson shall be such as may be determined by the State Government at the time of their appointment:

Provided that as respects any matter, which is not so specifically determined by the State Government, the regulations applicable in that behalf to the highest category of the officers in the whole time employment of the Authority shall apply to the Chairperson (if an expert person is appointed by the Chief Minister of Uttar Pradesh) and the Vice-Chairperson.

11. Other allowances such as travelling allowance, joining time, joining time pay, use of car efc. shall be regulated in accordance with the rules or orders made by the State Government for officers of the Transport Department of the rank of Additional Transport Commissioner.

CHAPTER-III Powers and Duties of the Chairperson and Vice-Chairperson

12.(1) In addition to presiding over the meeting of the Authority and discharging the powers delegated to him by the Authority the Chairperson shall be executive head of the Authority and shall discharge the duties and excrcise the powers delegated to him by the Authority. The Chairperson shall, as the Chief Exccutive of the Authority, be entrusted, subject to any regulations made under section 40, with the overall responsibility of carrying out the purposes of the Act.

(2) The Chairperson shall,-

(i) attend meeting of the Authority unless prevented by sickness or other reasonable cause;

(ii) report to the Authority about the significant cvents and development in respect of the affairs of the Authority;

(iii) be responsible to the State Government regarding the functioning and performance of the Authority;

(iv) transmit, as soon as possible, to the State Government, a copy of the minutes of every meeting of the: Authority;

(v) submit by first week of every month, a report to the State Government on the activities and performance of the Authority during the preceding month and submit report on such matters as may be directed by the State Government from time to time; :

(vi) carry out all directions of the State Government in connection with the affairs of the Authority given in writing;

(vii) discharge such specific duties or assignments in respect of any matters connected with the affairs of the Authority as the State Government may consider fit to entrust to him;

(viii) carry out or cause to be carried out all directions, decisions, and - orders of the Authority;

. (ix) exercise supervision and control over the acts of all employees of the Authority in matters of executive administration and in matters concerning the accounts and records of the Authority;

(x) exercise the powers of granting extension of service to, granting leave to, suspending, reducing, compulsory retiring, removing or any other question relating to the services of any officer or employee of the Authority, including the power of dispensing with the service of any such officer or employee otherwise than by reason of the misconduct of such employee.
