Section 85: Oath of allegiance to be taken by the 3Mayor and members

85. [(1) Notwithstanding anything contained in the Indian Oaths Act, 1873, every person who is elected a [Corporator] [***] or co-opted as a member of the Development Committee and every person who is elected a [Mayor] shall before taking his seat make an oath or affirmation in the following form, namely ;

I, A.B., having been elected [****] /Member of the

[Mayor] / Development

Committee

of this [Corporation] do swear in the name of God

solemnly affirm

that I will bear true faith and allegiance to the Constitution of India as by law established, that I will uphold the sovereignty and integrity of India and that I will faithfully discharge the duty upon which I am about to enter ;

[ (1-A) Within seven days of the constitution under section 9 or reconstitution under section 538 of the Corporation the Municipal Commissioner shall convene a meeting of the Municipal Corporation. The Commissioner of the division or in his absence the District Magistrate shall administer the oath or affirmation to the Mayor and thereafter the Mayor shall administer the oath or affirmation to Corporator who have been declared elected. Such meeting shall be presided over by the Commissioner of the Division or in his absence the District Magistrate. The meeting so convened, shall be treated as the First Meeting of the Municipal Corporation. ]

(2) Any person who having been elected a [Corporator] or [Mayor] [***] or co-opted a member of the Development Committee fails to make within three months of the date on which his term of officer commences or at one of the first three meetings of the [Corporation] held after the said date, whichever is later, the oath or affirmation laid down in and required to be taken by sub-section (1) shall cease to hold his office and his seat shall be deemed to have become vacant.

(3) Any person required under sub-section (1) to make an oath or affirmation shall not take his seat at a meeting of the [Corporation], in the case of a person co-opted a member of the Development Committee at a meeting of such Committee, or do any act as @[Corporator], [***] or [Mayor] or such member of the Development Committee as the case may, be, unless he has made an oath or affirmation as laid down in sub-section (1).
