Rules for Elections to the Board of Indian Medicine, U. P.State Rules of Uttar Pradesh · 1939

(1) As soon as the counting, or if there is recounting, the recounting, is completed the Returning Officer shall prepare a return in Form X setting forth—

(a) the names of candidates for whom valid votes were given ;

(b) the number of valid votes for each candidate, and

(c) the number of ballot papers rejected, and shall permit any candidate or his representative to take a copy or abstract from the return.

32. The Returning Officer shall also record in the return mentioned in rule 31 the names of as many candidates as there are seats to be filled obtaining the highest number of votes and shall declare them elected and announce their names as candidates duly elected.

33. Where an equality of votes found to exist between any candidate and the addition of one vote -would entitle any candidate to be declared elected, the determination of the candidate to whom such one additional vote shall be deemed to have been given shall be made by lot to be drawn by the Returning Officer in the presence of the candidates or their agents who may be present at the moment,

34. The Returning Officer shall communicate the result of the election to the State Government by forwarding a copy of the return in Form X and the State Government shall notify the names of the candidates elected.
