Section 15: Scruny of nominaons

(1) The Returning Ocer shall then examine the Nominaon Papers and shall decide all objecons which may be made at the me of scruny to any nominaon andmay, either on such objecons or on his own moon aer such summary inquiry, if any, as he thinks necessary, reject any Nominaon Paper on any of the following grounds---

(a) thahecandidateisnotqualiedtobeelectedasamemberundertheActorthese rules;

(b) thahecandidateisdisqualiedforbeingelectedasamemberundertheAct,orthese rules;

(c) thaherehasbeenafailuretocomplywithanyoheprovisionsoheActorrules;

(d) thahesignatureohecandidateortheproposerortheseconderisnotgenuine;

(e) that the candidate or the proposer or the seconder isa person whose name is not entered in the list of voters :

Provided that the nominaon of a producer duly supported by the proposer and theseconder shall not be rejected merely on the ground, that his name is not entered in the list ofvoters.

(2) Nothing contained in clause (c), OD or (e) of sub-rule (1) shall be deemed to authorise the rejecon of the Nominaon Paper of any candidate on the ground of any irregularity in respect of that Nominaon Paper if the candidate has been duly nominated by means of another Nominaon Paper in respect of which no irregularity has been commied.

(3) TheReturning Ocer shall notrejectanyNominaonPaperontheground ofanytechnical defect or other error which is notof a substanal character and may for the purposes of removing any such defect or error allow any entry to be corrected in the Nominaon Paper.

Illustraon.— WhenacandidatebelongingtotheScheduledCasteshasinadvertentlyomied to specify the parcular caste to which he belongs, he may be permied to specify the same under this sub-rule.

(4) The order of the Returning Ocer allowing any correcon to be made under sub-rule (3) shall be nal and shall not be quesoned in any Court of Law.

(5) The Returning Oicer shall hold the scruny on the date and me appointed in this behalf and he may allow adjournment of the proceedings, if he thinks it t in the interest of work but, the scruny shall be completed before the date and me xed for withdrawal,

(6) The Returning Ocer shall endorse on each Nominaon Paper his decision accepng or rejecng the same and if the Nominaon Paper is rejected, shall record inwring a brief statementof reasons for such rejecon.
