(1) The Presiding Ocer shall regulate the admission of voters at the polling place and shall exclude therefrom allother persons except :
(a) thePollingOicer;
(b) lieeachcandidate,hisEleconAgentandhisPollingAgent;
(c) thePoliceOcerandotherPublicServantsonduty;
(d) achildinarmsaccompanyinga voter;
(e) thecompanionolindorinrmvoterwhocannotmovewithouthelp,and
(f) such other persons as the Presiding Ocer may from me to me admit for the purpose of assisng him in taking the polls.
(2) The Presiding Ocer shall close the Polling Staon at the hour xed for the close of polling under clause (d)6f sub-rule (2) of Rule 9 and shall not admit any voter aer that hour:
Provided that all voters present within the Polling Staon before it is so dosed shall be entled to have votes recorded.
(3) If any queson arises as to whether any voter shall for the purpose of the proviso to sub-rule (2) be deemed to be present within the Polling Staon before it is closed, the queson shall be referred to the decision of the Presiding Oicer and his decision shall be nal and shall not be quesoned in any Court or Tribunal.
20-A. Arrangement for secrecy of vong [Secons 13(2), 40(2)(i) and 40(2)(xxxi-a)].—The polling place shall be furnished with a polling compartment in which voters can record their votes screened from observaon.
20-B. Preparaon of Ballot Box for the poll.—The Presiding Ocer shall, immediately before the commencement of the poll, allow the contesng candidates and their agents who may be present at such place to inspect each Ballot Box to be used at the poll and shall demonstrate to them that it is empty. The Ballot Box shall then be closed before such of the persons aforesaid as are present.
20-C. Placing of Ballot Boxes for receipt of ballot papers.—Every Ballot I5ox shall be placed for the receipt of ballot papers in the view of the Presiding Ocer, the contesng candidates and their agents.
20-D. Idencaon of voters.---(1) The Presiding Ocer may employ at the polling place such persons as he thinks t to help him in the idencaon of the voters or to assist him otherwise in taking the poll.
(2) As soon as voter enters the Polling Staon the Presiding Ocer or such other person on duty authorised by him in this behalf shall check the voters' name and other parculars with relevantentry in the list of voters and then call out the serial number, name and other parculars of thevoter.
(3) Any contesng candidate or his agentmay challenge the identy of avoteron paymentof rupees two in cash and where such challenge is made, the Presiding Ocer shall hold a summary enquiry into the challenge and may for that purpose require the challenger to adduce evidence, in proof of the challenge and the person challenged to adduce evidence, in proof of his identity.
(4) If aer such enquiry the Presiding Ocer is of the opinion that the challenge has not been established, he shall allow the person challenged to vote and if he considers that the challenge has been established, he shall debar the person challenged from vong.
(5) If the Presiding Ocer is of the opinion that the challenge is frivolous or has not been made in good faith, he shall direct that the deposit made under sub-rule (3) be forfeited to the Board and in any other case he shall return it to the challenger akthe nondusion of the inquiry.
(6) In deciding the right of a person to obtain a Ballot Paper, the Presiding.Ofcer shalt overlook merely clerical or prinng errors in entry in the list of voters provided that he is sased that the entry relates to such person.
23 THE UTTAR PRADESH KRISHI UTPADAN MANDI NIYAMAWALI-1965 58 THEU.P.KRISHIUTPAOANMANDINIYAMAVALI, 1965 [RULE5A-34 20-E. Issue of ballot papers to voters.—(1) Aer theidentyof avoter had beenestablished aBallot Paper shall be issued to him.
(2) At the me of issuing any Ballot Paper to a voter, the Presiding Ocer shall record, in such manner as the Director of Elecons may direct, the serial number thereof against the entry relangto the voter in a copy of the list of voters set apart for the purpose (hereinaer in these rulesreferred to as the marked copy of the voters' list).
20-F. Maintenance of secrecy of vong by voters within Polling Staon and vong procedure.—(l) Everyvoterto whom a BallotPaperhasbeenissued under Rule20-Eorunder anyotherprovisionsof these rules, shall maintain secrecy of vong within the Polling Staon and for that purpose observe, the vong procedure hereinaer laid down.
(2)ThevoteronreceivingtheBallotPapershallforthwith—
(a) proceedtothevongcompartment;
(b) put a mark on Olt t allot Paper with the instrument supplied for the purpose on or nearthe symbol of the candidate or candidates for whom he intends to vote;
(c) foldtheBallotPapersoastoconcealhisvote;
(d) ifrequired,showtothePresidingOcer,thedisnguishingmarkontheballotpapers;
(e) insert the folded Ballot Paper into the Ballot Box; and (f) quit the polling place. (3) Every voter shall vote without undue delay.
(4) Novotershallbeallowedtoenteravongcompartmentwhenanothervoterisinsideit.
(5) If a voter to whom a Ballot Paper has been issued refuses, aer warning given by the Presiding Ocer to observe the procedure as laid down in sub-rule (2), the Ballot Paper issued to him shall,
(6) whetherhehasrecordedhisvotethereonornot,betakenbackfromhimbythePresidingOcer.
(7) Aer the Ballot Paper has been taken back, the Presiding Ocer shall record on its back the words "Cancelled—vong procedure violated" and put his signature below these words.
(8) All the ballot papers on which the words "Cancelled—vong procedure violated" are recorded, shall be kept in a separate cover which shall bear on its face the words "Cancelled ballot papers— vong procedure violated."
(9) Without prejudice to any other penalty to which a voter from whom a Ballot Paper has been taken back under sub-rule (5) may be liable, the vote, if any, recorded on such Ballot Paper shall not be counted.
