Section 38: Casual vacancy in the Oce of the Chairman or Vice-Chairman (Secons 15 and 40(2)(ii))

The manner of lling a vacancy under Secon 15 in the Oce of the Chairman or Vice- Chairman, as the case may be, shall be the same as that of elecon to that oce under these rules.

(2) Withoutprejudicetothegeneralityoheprovisionsofsub-rule(1),theChairmanorinhis absence the Vice-Chairman shall—

(i) presideoverthemeengsoheMarketCommieeandconductbusiness,atsuch Meengs;

(ii) keepawatchoverthenancialandexecuve administration;

(iii) direct in cases of emergency the execuon or stoppage of any work, or the doing of any act which requires the sancon of the Market Commiee :

Provided that the sancon of the Market Commiee shall be obtained within 30 days from the date of such direcve.

(3) The Chairman shall be the authority competent to grant casual leave to the Secretary.Per. other kinds of leave, the Secretary shall apply through, the Chairman to the Director who shall take acon to sancon leave in accordance with the rules governing the condions of service of the Secretary.

(4) The Chairman shall communicate to the Director by thireth April each year, his annual condenal remarks in respect of the work and worth of the Secretary. (5) The Chairman shall send to the Director his recommendaons in respect of the annual increment of the Secretary within 30 days from the date such increment falls due.
