34 THE UTTAR PRADESH KRISHI UTPADAN MANDI NIYAMAWALI-1965 66 THEU.P.KRISHIUTPADANMANDINIYAMAVALI, 1965 [RULE35 CHAPTERIII ELECTIONOFCHAIRMANANDVICE-CHAIRMANAND THEIR POWERS AND DUTIES 1 [135.EleconofChairmanandVice-ChairmanoheMarketCommiee—(1)Returning Ocer.— The Collector of the District, where the Principal Market yard of the Market Commiee exists or an ocer nominated by him, not below the rank of a Deputy Collector shall be the Returning Ocer for the elecon of Chairman and Vice-Chairman of the Market Commiee.

At least one Assistant Returning Oicer not below the rank of a Tehsildar shall also be nominated by the Collector for each such elecon to aid and assist the Returning Ocer for exercise of such powers and funcons of the Returning Ocer as the Returning Ocer may direct.

(2) Declaraon of Elecon.— As soon as the nocaon of nominaons of the members of Market Commiees is published (not later than 10 days from the date of publicaon of such nocaon) an oath of oce shall be administered to the nominated members by the Collector or an ocer nominated by him for thisjaurpose. A Market Commiee will be deemed to be constuted when atleast 2/3 of the total number of the members have taken their oath of oce. The state Government may x a date for the elecon of the Chairman and Vice-Chairman of the Market Commiees in the State through the publicaon of nocaon.

Provided that generally the same date shall be xed by the State Government for such elecons but dierent dates may be xed for elecons for dierent Market Commiees as it deems t.

A list of nominated members who have taken oath shall be published and be pasted on the Noce Board of the Market Commiee and on other prominent places of the Market Commiee as soon as the oath of oce has been administered to the elected members. The nominated members who have taken oath on or before the date of declaraon of the elecon shall be treated as the electorate.

In consonance with the nocaon issued by the State Government date, me and place of the elecon shall be published in two newspapers of wide local circulaon and also be displayed on the Noce Board of Market Commiee.

(3) Nominaon for the elecons of the post of Chairman and Vice-Chairman.—The nominaon for the post of Chairman and Vice-Chairman shall be led before the Returning Ocer in the format given in the Form-XI.

The nominaon form shall be presented personally on the date of elecon before the Returning Ocer between 10 a.m. to 12 a.m. The nominaon form will be scrunized just thereaer and the nominaon can be withdrawn before 02.00 p.m. on the same day.

(4) Displayoistofcontesng candidates. —The namesof thecontesng candidates shallbe displayedonthe Noce Boardohe Market Commiee immediately thereaer,under the signature of the Returning Ocer.

(5) Elecon Procedure.— The elecon of Chairman and Vice-Chairman will be conducted, by secret ballot paper containing the name, father's name, address of the contesng candidates along with their photographs and unopposed candidate or the candidate securing maximum number of votes shall be declared elected. In case of a e the decision shall be taken on the basis of a draw of lots.

(6) The choiceby thevoterwill bemarkedonly by theinstrument providedto him and in themanner prescribed as well as communicated to him by the Returning Ocer.

(7) The elecon of the Chairman and Vice-Chairman shall be conducted simultaneously and separately.

(8) Declaraon of results.— The vong will start from 3.00 p.m. and will be closed at 4.00 p.m. Immediately thereaer the votes shall be counted by the Returning Ocer. The Returning Ocer shall declare the names of elected Chairman and Vice-Chairman in the Form-MIA and a cercate in the Form X1113 will also be handed over to them thereaer.

The names of elected Chairman and Vice-Chairman shall be sent to Director, Markeng Board and to the Principal Secretary, Agricultural Markeng and Agricultural Foreign Trade, Government of Uar Pradesh by the Collector in his signature and seal immediately aer such declaraon.

(9) An elecon peon may be led against such elecon before the Commissioner of the Revenue Division within 30 days of the declaraon of such results.

(1) of Secon 13 and persons elected as Chairman and Vice-Chairman shall, as soon as may be, aer their nominaon as such member and aer elecon as Chairman and Vice- Chairman, be administered oath of oce as follows by the Collector or his nominee at the place and me which may be xed for the purpose by him.
