Section 19, Uttarakhand Fisheries Rules,2003

(1) The office bearer mentioned in appendix VII shall be empowered to seize or remove or confiscate the apparatus established or used for catching the fish contrary to the rules.

(2) The office bearer mentioned in appendix VII shall also be empowered to for feit all fish and box/ bag caught by any apparatus.

(3) The office bearer, mentioned in appendix VII, may take required action under the provision of the Act against the concerned person for such offence in violation of aforesaid sub rules.

(4) If the fish for feited in sub rule (2)is alive, it shall be put in the reservoir on the same place immediately by the office bearer mentioned in appendix VIII and if fish is dead, after weighing it in the nearest weighing centre and selling on the prevalent rates, the acquired amount shall be deposited in the treasury.

Ban of stocking fish seed of prohibited fishery species Tilopiya, Bighead, Thai Mongur etc.

20. No person shall be allowed to stock the fish seed of Tilopiya species,Big head and foreign Thai Mongur in the pond, puddle, jheel, water, river and streams. Any person violating this rules shall be liable for the punishment provided under section 5 of the Act.

Fishing of the fish specified in Schedule 2 part-II

(a)of the Wildlife

21. Fishing of the following fish specified in part II (a) of Schedule 2 of Section 9 of Wild Life Protection Act,1972 shall be prohibited-- 21 Protection act, 1972 shall be prohibited

(1) Timi Grah (Rhynocodone Typus)

(2) Grah and Prithika

(i) Anoxipristis Kuspideta,

(ii) Cachirhinus hamiodone,

(iii) Glifius Gajatix,

(iv) Glifius Glifius,

(v) Himantura Flucea-Taryalas,

(vi) Pristis Mycrodone,

(vii) Pristis Jinstrone,

(viii) Rihancobatus Diyedencita,

(ix) Yurozimnus esperigus.

(3) Grah and prithika (all elesmobranchy eye) Ashwamin(all Sighethediun)

(4) Bheem groupesmin (Apnsefelus Lasiyo letus) To keep the fishing craft and gears in the extent of specified area

22. No person shall keep the fishing craft and gears within the periphery of three kilometer of the specified waters, which are not private, in his jurisdiction. Office bearer appointed by the State Government shall empowered for confiscation of such fishing craft and gears for the proceeding against such person.

Right of Appeal 23. If it appears to the aggrieved party (permit holder of angling/ fishing or institution/ person who has been given the license/ contract of fishing) that the proper proceeding has not been made in his/ its matter, in such case he shall be entitled to appeal before State Government against the order given by lower rank officer with in maximum one month from the date of issuing it. The decision given by the State Government regarding the matter in questioned shall be final and binding.

Power to remove difficulty

24. If any difficulty arises in giving effect to the provisions of these rules, the State Government may, by order which is not inconsistent with the provision of Act and these rules,remove The difficulty.

Signature of permit issuer 29 AppendixV(2) Necessary directions and conditions for the permit holder regarding the permission of Angling and fishing from the net of two inch or larger dimension should be printed on the back page of permit-- 1- Permit shall be permissible under the powers of the provisions of the Uttarakhand Fisheries Act,

2003.

2- Permit shallbe non transferable/non convertible.

3- The permit holder shall not convert (change) the place, for which the permit related to the permission of Angling and fishing by the net of two inch or larger dimension was issued by the permit issuing institution/ officer of department unless the permission is granted by the permit issuing institution.

4- The permit issuing Institution/ officer of department may deny to issue such permitto renew the said permit. If it/ he is satisfied that it is not appropriate in public interest to issue/ renew such permit.

5- It is obligation of the permit holder to show the permit to the person authorised by see 8(1) of the Uttarakhand Fisheries Act, 2003.

6- The permission of Fishing of any kind in addition to angling in the allocated purview in other water reservoir (except than the artificial water reservoir) of hilly area other than the general waters , hilly area and general jheel hilly area where the fishing is permitted also by the net of two inch or larger dimension along with Angling.

7- Fishing is permissible by the Angling from sunrise to sunset.

8- The permit holder shall not catch or kill or sale any fish of weight less than the weight marked in front of the fishery mentioned species wise in the following table:- 1 Rainbow trout Weight of less than 300gram 2 Brown trout Weight of less than 300gram 3 Snow Trout Weight of less than 250 gram 4 Common carp Weight of less than 300gram 5 Mahseer Weight of less than 400 gram 6 Catla Weight of less than 500 gram 7 Rohu Weight of less than 500gram 8 Nain Weight of less than 400 gram 9 SilverCarp Weight of less than 500 gram 10 GrassCarp Weight of less than 500 gram 11 Cania fish Weight of less than 300gram Note- In addition to the above said mentioned fishery species catching, killing or selling of other fishery species of the fish of the weight less than 500 gm in plain areas and the fish of weight less than 250 grm in hilly areas are prohibited.

30 9- The fish of the weight less than the mentioned above caught by the permit holder shall left it in water reservoir.
