The West Bengal Primary Education Act, 1973State Act of West Bengal · Act 43 of 1973

(1) There shall be a Chairman and a Vice-Chairman of a Primary School Council.

(2) The Chairman and the Vice-Chairman shall be elected by the members of the Primary School Council from among themselves in such manner as may be prescribed and shall, subject to the provisions of section 45, hold office for a term of four years mentioned in section 42:

Provided that until a Chairman is elected by the members of the Primary School Council for the first time the State Government may appoint a person to be the Chairman of the Primary School Council and the person so appointed shall hold office until a Chairman is elected by the members of the Primary School Council and assumes office.

(3) The Chairman and the Vice-Chairman shall receive such pay or allowances or both as may be fixed by the State Government.

(4) The Chairman may resign his office by giving notice in writing to the Primary School Council and when such resignation is accepted by the Primary School Council the Chairman shall be deemed to the vacated his office.

(5) The Vice-Chairman may resign his office by giving notice in writing to the Chairman and when such resignation is accepted by the Chairman the Vice-Chairman shall be deemed to have vacated his office.

45. If at a meeting of the Primary School Council specially Removal convened for the purpose a resolution is passed against the Chairman or of the the Vice-Chairman by a majority of the then members of the Primary and die an School Council and by a majority of not less than two-thirds of the Vicmembers of the Primary School Council present and voting such Chairman.

resolution shall have the effect of removing the Chairman or the Vice-Chairman, as the case may be, from his office as from the date on which the esolution is so passed.

Discharge 46. (1) (a) In the event of the occurrence of any vacancy in the of Chair- office of the Chairman by reason of his death, resignation or removal, or man's functions otherwise, or, in certain contin- (b) when the Chairman is unable to discharge his functions owing gencies. to absence, illness or any other cause, the Vice-Chairman shall exercise the powers, perform the functions and discharge the duties of the Chairman until a new Chairman is elected and assumes office or until the Chairman resumes his duties, as the case may be.

(2) In the event of the occurrence of vacancies in the offices of both the Chairman and the Vice-Chairman the State Government may appoint a member of the Primary School Council to exercise the powers, perform the functions and discharge the duties of the Chairman until a Chairman or a Vice-Chairman is elected and assumes office.

(3) A Chairman elected to fill a casual vacancy shall hold office for the unexpired portion of the term of the Chairman whose place he fills.

Disquali- 47. The provisions of section 12 shall mutatis mutandis apply in the fications case of a member of a Primary School Council. for membership.

Resign- 48. A member of a Primary School Council may resign his seat by tion mb ofers. giving notice in writing to the Chairman and when such resignation is me accepted by the. Chairman such member shall be deemed to have vacated his seat.
