Section 5: Criteria for transfers

(1) The transfer shall not be claimed as a matter of right by any officer or official.

(2) An official will be eligible for transfer on completion of minimum period of service or zonal period of service whichever is earlier:

Provided that the Competent Authority may order for premature transfer (without counselling), in public interest and administrative convenience, by recording reasons in the following cases namely: -

(i) In case of an officer or official having Special Knowledge/Expertise to be transferred to Central office; or

(ii) On grounds of Criminal case or Lokayukta or Departmental enquiry or serious complaints/allegations against the officers. In such cases the officers shall be transferred only to non-executive/Zone-C offices specified in Schedule-I or Schedule II as the case may be.

(3) On completion of zonal period of service, an officer will be compulsorily transferred, even if minimum period of service in current posting is not completed.

(4) The transfer of officers or officials shall be done in the following manner, namely:- 5

(i) Every official in the cadre of Senior Sub-Registrar or Sub-Registrar who are working as Sub-Registrar for five years or more out of last eight years in any of the Sub Registrar offices in Zone-A offices, shall be compulsorily transferred.

Only posts outside Zone-A may be available for selection in counselling for these officers.

(ii) Every official in the cadre of First Division Assistant or Stenographer who have worked for six years or more out of last eight years in any of the Sub Registrar offices in Zone-A offices, shall be compulsorily transferred. Only posts outside Zone-A may be available for selection in counselling for these officers.

(iii) An officer may not be eligible to choose a post in Zone-A as long as they fall under compulsory transfer category i.e. Senior Sub Registrars or Sub Registrars who have worked five years out of last eight years in Zone-A offices and First Division Assistants or Stenographers who have worked six years out of last eight years in Zone-A offices.

(iv) Transfers of all officials working in all other cadres except serial number-4, 5, 6 of Table under rule 3 shall be done as per the existing transfer guidelines published time to time by the Government.

(5) The competent authority may undertake transfers of cadres as in serial number 4, 5 & 6 of Table under rule 3 not exceeding five percent of the total number of posts in Zone –B and C, by recording reasons in writing.

Provided that, transfer on discretionary grounds under sub-rule (5) shall not apply to compulsory transfer cases and shall cover only posts within Zone-B and C and shall not apply for those transferred on disciplinary grounds.
