Section 26: Right to produce of naturally growing trees.

The Maharashtra Tenancy and Agricultural Lands (Vidarbha Region) Act.State Act of Maharashtra · Act 99 of 1958

(1) If the landlord has any right to the trees naturally growing on the land held by his tenant, the tenant shall during the continuance of his tenancy be entitled to two-thirds of the total produce of such trees, the landlord being entitled to one-third of the produce of such trees.

(2) If there is any dispute regarding the right to the produce of such trees or the apportionment of such produce as provided under sub-section (1), the tenant or the landlord may apply to the Tahsildar. Such application shall be made in such form as may be prescribed.

(3) On receipt of such application, the Tahsildar shall, after holding an inquiry, pass such order thereon as he deems fit.
