Section 16: Procedure for eviction of unauthorised occupants under the preliminary scheme

For eviction under section 31, the appropriate authority shall follow the following procedure, namely:-

(i) The appropriate authority shall in the first instance serve a notice upon the person to be evicted requiring him to vacate the land within such reasonable time, as may be specified in the notice.

(ii) If the person to be evicted fails to comply with the requirement of the notice, the appropriate authority shall depute any officer or official to remove him.

(ili) If the person to be evicted resists or obstructs the officer or official deputed under clause (ii) or if he re-occupies the land after eviction, the appropriate authority shall prosecute him under the Indian Penal Code, 1860.
