Section 3: Functions of the Board [Section 27(2) (a)]- (1) The Uttar Pradesh Rajya Dugdh Parishad, hereinafter referred to as the "Board" constituted by the State Government under Section 3 of the Act shall

(a) encourage organization of Primary Milk Co-operative Producers' Societies at the base level and Co-operative Milk Producer's Unions at district level and a Co-operative Dairy Federation at the State level with a view to Plan, develop and regulate milk production and dairy industry in the State on uniform pattern (hereinafter called co-operative pattern);

(b) utilize, as its authorised agency the services of the aforesaid Cooperative Dairy Federation at the State level for co-ordination of the activities of the aforesaid societies and unions and for such other services as required by the Board;

(c) advise the State Government on such matters, as may be referred to it from time to time;

(d) conduct studies and report to the Government on matters relating to development, regulation and control of production, supply and distribution of milk and its conversion into milk products with a view to develop dairy industry in the State;and 6

(e) suggest ways and means to the Government for rehabilitation of sick dairies.

(2) Conduct of business of the Board [Section 27(2) (a)]-The Board shall meet at least four times in a year.

(3) The quorum at any meeting of the Board shall be one-third of the number of members of the Board currently holding office. If no quorum is formed within half an hour of the time fixed for the meeting, the meeting shall stand adjourned to a date to be notified later. There shall be no quorum for an adjourned meeting.

(4) Meeting of the Board shall be held at Lucknow unless otherwise directed by the Chairman and at such place, date and time as the Chairman may fix.

(5) The Secretary shall give at least fifteen days notice in writing of a meeting of the Board. The notice shall be accompanied with an agenda note to all the members. In case of emergency of which the Chairman shall be the sole judge, the notice period may be reduced to three days by the Chairman.

(6) The Board shall have power to appoint a sub-committee or subcommittees to examine and advise on any specific problems in regard to the administration of the Act. It may also co-opt on the sub-committee technical experts who may not be members of the Board.

CHAPTER III Appointment of Members in Casual Vacancies in the Board

4. Filling of Casual vacancies in the Board- If a vacancy occurs by death, resignation or otherwise against the seat of any non-official member of the Board, the vacancy so caused shall be filled up by nomination as under Section 4 of the Act, and any person appointed to fill such vacancy shall hold office for so long only as the member in whose place he is nominated would have held the same.

CHAPTER IV Duties, Powers and Functions of the Milk Commissioner

5. Duties of Secretary of the Milk Board [Section 27 (2) (b)]- The Milk Commissioner shall be the ex officio Member Secretary of the Uttar Pradesh Rajya Dugdh Parishad and will perform the duties as under-

(i) to convene the meeting of the Uttar Pradesh Rajya Dugdh Parishad with the approval of its Chairman;

(ii) to record the minutes of the meetings of the Board and to circulate copies there of amongst its members;

(iii) to represent the Board in courts, including the Supreme Court and the High Court, to instruct counsel to sign pleadings, to put in affidavit and to do all such other acts incidental or ancillary to prosecute or defend a case for or on behalf of the Board;

(iv) to apprise the State Government of the decisions taken by the Board;

(v) to arrange payment of T.A. Bill etc., of the members of the Board;

(vi) to authenticate all communications, permissions, orders, decisions and other documents of the Board on behalf of the Board.
