(1) Permit by the body prescribed in rule 5 shall be issued on the specified form (under annexed Appendix V).
(2) The permit obe issued shall be invariable/nontrans ferrable.
(3) The validity of Angling permit to be issued as above shall be for one day.
(4) In the abovesaid permit the permission of fish sport/ fishing by angling shall be permissible from sunrise to sunset.
(5) Number of the fish caught from Angling/ fishing by the body prescribed in rule 5 and details of the income acquired from 14 the issued Angling/ fishing permit shall be maintained separately for each day.
(6) (i) If beat allocation is issued by the Fishery Department for fish sport/ fishing by angling or from the net of two inch or large size dimension, then 80 percent of the acquired income from the beat fee shall have to deposit in the account head of the relevant department receipt of State Government of fishery department and 20 percent,in the account head of relevant departmental receipt of State Government of the department of ownership of waters as a royalty of the waters.
(ii) If the beat is issued by the department with the ownership of related waters, 80 percent of the acquired income from beat fee shall have to deposit in the account head of the relevant department receipts of the State Government of the department with ownership of water and 20 percent, in the account of relevant department receipts of the State Government of fishery department as the cost of fish seed.
(iii) If the beat is allocated by the tourism department, 20 percent of the earned income from the beat fee shall have to deposit in the account head of relevant department receipts of State Government of fishery department as the cost of fish seed and remaining 80 percent shall be distributed between the tourism department and the department with the ownershipof waters in the ratio which has been determined by the tourism department and department with the ownership of waters with mutual consent. Accordingly the said amount shall also have to deposit in the relevant departmental receipts.
(7) It is necessary to every license holder/ permit holder to show the license/ permit on the demand of person authorised insub section (1) of section 8 of the Act. Any person shall be liable for the punishment under the provision of Section 5 of the said Act on fishing without permission by any method.
(8) Beat allocator department/ Officer or territorial offices of fisheries department shall authorise to cancel the permit/ license of the permit/license holder on the violation of Act 15 Or any provision or part there of made the reunder.
(9) Fisheries/ catching the trout/ Mahseer fish, more than four in a day, by the permit/ license holder, shall be prohibited.
(10) It shall required by the anglers and their associates to maintain complete tranquility, minimum activity and minimum interfare in the environment.
(11) During angling in water reservoir under control of forest department, on violation of various Acts or rules made thereunder applicable in the state by the angler/ anglers the prescribed body may immediately ban/ cancel such angling but if beat has been allocated by any other department except the fishery department or forest department, in such case fishery or forest department shall forward the recommendation of cancellation of the licence to the concerned department by which the beat allocation license has been issued. Proceeding of cancellation of the beat allocation licence may be done accordingly.
(12) The fishing shall be prohibited completely during the breeding season mentioned appendix 6(1) and appendix 6(2) of in these rules in all water reservoirs mentioned in sub-rule 11;
Provided that in local melas related to the fishing/fish sports in the state like. Maud mela which held in district Tehri/Dehradun/ Uttarkashi etc, the water reservoir within the range of meles shall keep free from the prohibited area with a view to the rights of local peoples;
Provided further that Scheduled tribes and other traditional forest dwellers shall be permissible for the exemption for fishing for their own use with their traditional methods under Scheduled Tribes and other Tradition Forest. Dwellers (Recognition of Forest Rights) Act, 2006.
Directions by institutions regarding fishing through the Tenders in water
